These Terms of Service (“Terms”) govern your access to and use of the website located at babacanplaza.com (the “Site”) and any related consumer services offered for customers in the United States. By accessing the Site, submitting a form, placing an order through our client-side cart, or booking a service, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Babacan Plaza operates as a platform that connects consumers with independent service professionals and packaged service offerings for home cleaning, office cleaning, maintenance, and related consumer services. Unless expressly stated in writing, Babacan Plaza is not the direct employer of field technicians; professionals may be independent contractors or employees of affiliated service partners. Service descriptions on the Site are for general information and may be customized in your booking confirmation.
You must be at least eighteen (18) years old and capable of forming a binding contract to use the Site. By using the Site, you represent that you meet these requirements. If you book services on behalf of a business, you represent that you have authority to bind that entity to these Terms.
Certain features require you to submit accurate contact information through forms on the Site. You agree to provide truthful, current, and complete information and to update it as needed. We may contact you via email regarding quotes, scheduling, service updates, and marketing (where permitted). You may opt out of marketing emails using the unsubscribe page linked in our footer.
Product packages displayed on the Site include indicative pricing for planning purposes. Final pricing may vary based on property size, scope, travel, materials, or urgency. When you complete cart checkout on the Site, you acknowledge that:
You agree to provide safe access to the service location at the scheduled time, including disclosing pets, alarm codes (when legally permitted), parking restrictions, and known hazards. You are responsible for securing valuables and informing professionals of fragile or sensitive areas. Delays caused by lack of access may result in rescheduling fees. Children and unauthorized persons should be kept away from active work areas for safety.
Cancellation and rescheduling policies depend on service type and notice provided. Generally, we request at least twenty-four (24) hours’ notice for standard residential bookings. Same-day cancellations, repeated no-access events, or unsafe conditions may incur fees up to the full value of the scheduled service. Commercial contracts may include separate terms in a signed agreement.
We strive for high-quality outcomes and encourage you to report concerns within seven (7) days of service completion. Remedies may include touch-up visits, partial credits, or re-performance of specific tasks, at our discretion and subject to verification. Satisfaction guarantees do not cover pre-existing damage, normal wear, or issues outside the agreed scope.
You may not misuse the Site, including attempting to interfere with security, scraping content without permission, submitting false orders, harassing staff or professionals, or using services for unlawful purposes. We may suspend access for violations.
The Site, logo, text, graphics, layout, and software are owned by Babacan Plaza or licensors and protected by United States and international intellectual property laws. You receive a limited, non-exclusive license to access the Site for personal, non-commercial use. You may not copy, modify, distribute, or create derivative works without written consent.
The Site may contain links to social sharing platforms or third-party resources. We are not responsible for content, policies, or practices of third parties. Your use of third-party sites is at your own risk.
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABACAN PLAZA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SITE.
Service outcomes may depend on property conditions, materials, and factors beyond our control. Emergency or life-safety situations (gas leaks, electrical fires, structural collapse) require immediate contact with local emergency services.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BABACAN PLAZA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO BABACAN PLAZA FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRECEDING THE EVENT, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless Babacan Plaza from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of third-party rights.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where federal law applies. Any dispute shall be resolved through binding arbitration on an individual basis, except that either party may seek injunctive relief in court for intellectual property misuse. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.
We may update these Terms periodically. Material changes will be posted on this page with an updated “Last Updated” date. Continued use after changes constitutes acceptance.
